VISITING WINDOWS
Once-daily visits: we arrive between 8a-1130a to give care and companionship to your babies.
Twice-daily visits: we arrive between 5:30-7:30a (mornings) and 3:30-6:30p (evenings) to give care and companionship

HOLIDAY POLICY
Holiday rates apply during and surrounding dates of: Memorial Day, Labor Day, July 4th, Thanksgiving, Christmas, New Years
Non-refundable cancellation fees apply

COVID-19
Our sitters will be mindful of and reduce touching surfaces and objects in your home
Wash or sanitize their hands between each client visit
Each pet care professional will use disinfectant wipes and hand sanitizer (as they are obtainable or provided by you in your home) and secondly soap and water
If you have any disinfectant products you would like us to use, please leave them on your counter. This keeps everyone safer and is extremely helpful toward sanitizing before your return home
If a team member has any cold or flu-like symptoms, they will communicate and have their work reassigned immediately to another trained team member sitter

SERVICE AGREEMENT, DATES & PAYMENT

1. MBB Enterprises, LLC dba Companion Keepers Cat Sitting, a pet sitting service, shall include its agents, employees and/or authorized representatives, and shall also be referred to, in this contract,
as “Companion Keepers Cat Sitting”, “Companion Keepers”, “you”, “your” or “company”. The person with whom Companion Keepers is contracting for its pet sitting services shall be referred to, in this contract, as “the client”, or as “I” (any other forms of singular first person pronouns). “The client” and/or “I” and Companion Keepers together, shall be referred to, in this contract, as “the parties”.
2. I agree that the initial term of this contract shall be the dates and visits as selected and confirmed in my “Time To Pet” account here with Companion Keepers. I agree to check these dates and visits for accuracy before departing on my trip. I further agree that any changes I request in my reservations after I’ve completed this document will be updated, viewable, and verified by me in my online client account.
3. In the event of my early return home, I understand that I must notify my pet sitter promptly. I understand cancellation policies apply for unnecessary visit(s). I understand that if I fail to notify my pet sitter of my early return home, that I will be charged for any visits made to my home to care for my pet(s), despite my early return.
4. By signing this contract, I authorize your company to perform future services. I authorize your company to perform the services set forth in my initial scheduled services and to perform the services I subsequently agree to request via text, email, telephone, or my client account. I authorize your company to perform these services for future and additional dates requested, and allow your company to enter my premises without an additional signed contract, written agreement or written authorization to perform for the specific purpose of performing said services. I agree to pay for the services that I subsequently verbally authorize. I agree to pay the fees set forth in my invoice. If your fees have changed from the fee which I last paid for your services, I understand you send notice of the rate increase within the app and email and will agree to pay the new fee.
5. Any additional visits made or “additional services” performed shall be paid for at the agreed contract rate as listed immediately above which will also be reflected in my online client account per service, per day. Any changes I’ve made in my reservations after requesting from the company will be reflected in my client account online with the agreed upon invoice total using the agreed upon rates. Any “additional visits”, the service performed shall be performed as outlined in this contract. Any “additional services” shall be performed as specified in the next sentence of the paragraph. 6. CANCELLATIONS AND LATE BOOKING POLICIES

For CANCELLATIONS NOT INCLUDING PEAK HOLIDAYS:
72 hours/3 days or more away from your first service: no charge
72 hours/3 days away from your first service: cancellation fee of 50% of the invoiced rate is charged on all canceled services
48 hours/2 days away or less away from your first service: cancellation fee of 100% of the invoiced rate is charged on all canceled services

7. PEAK HOLIDAY CANCELLATIONS:
For holiday periods: NEW YEARS, JULY 4th, THANKSGIVING, LATE DECEMBER, we will make every effort to fill your canceled visits with wait-listed clients waiting for an opening but this is not always possible. If the company cannot refill my reserved space, I agree to the cancellation policies for unused visits are as follows:
Once the company is completely booked and they are rejecting new bookings (generally early fall):
Early Fall to 31 days ahead of the holiday period: cancellation fee of 50% of the invoiced rate for canceled services not refilled by wait-listed clients
30 days or less in advance of holiday period: cancellation fee of 100% of the invoiced rate for canceled services not refilled by wait-listed clients

8. LAST MINUTE BOOKINGS
$20 charge is added to services scheduled 48 hours or less in advance of the start date.

9. LATE PAYMENTS
If the Company receives my payment more than 30 days after the date of the invoice, I agree to pay a late fee of $50.00. If the company has no not received my payment more than 60 days after the date of the invoice, I agree to pay a five percent simple interest on the unpaid invoice. Interest begins accruing on the invoice due date. If I have not paid my invoice for more than 90 days, the company may refer the collection of my unpaid amount to an attorney or collections agency. If my unpaid invoices are referred to an attorney or collections agency, I shall pay all reasonable attorney’s fees or collections agency fees.

HOME CARE SPECIFICATIONS

1. If an individual other than an employee/associate of Companion Keepers is to be providing pet/home care in conjunction with Companion Keepers, it is also understood and agreed upon by me that Companion Keepers shall not be held responsible for my pet’s injury/disappearance, death, doors left unlocked, theft, security of the premises or loss if other individuals have access to the home.
2. House keys are kept on file or returned in person unless otherwise specified.
3. I understand cluster box mail should be held due to mail theft and mailbox break-ins. I understand that mailbox clusters requiring walking or driving to for retrieving mail may result in additional visiting time and applicable charges.
4. I expressly give Companion Keepers the authority to employ a locksmith on their behalf and to promptly reimburse Companion Keepers for all costs incurred in the event of a malfunction of the lock, keys or automatic door opener
5. I understand the company is not liable for any loss or damage in the event of a burglary or other crime that should occur while under this contract.
6. I agree to properly secure my home prior to leaving the premises. Companion Keepers will re-secure the home to the best of its ability at the end of each visit.

PET CARE SPECIFICATIONS

1. I understand that In the event of my pet’s death during my absence, default arrangements are to have my vet hold remains unless specified otherwise.
Neither your pet sitter or Companion Keepers will be liable for injury, disappearance, death or fines of pet(s) with access to the outside.
2. I specifically authorize your company to perform care and services as outlined in this contract. I also authorize emergency veterinary pet care for my pet(s), if, in your discretion, you find it reasonably necessary; and I agree to be solely liable for all costs and fees incurred as a result of transportation, treatment, veterinary care, illness of the pet and required medications, and also agree to release you from all costs and fees incurred as a result of same. Should my specified veterinarian and I be unavailable, I authorize your company to engage the services of the veterinarian that your company, in its discretion, chooses. If I cannot be reached in a timely manner, I further authorize your company to approve medical and/or emergency treatment (excluding euthanasia) as recommended by a veterinarian. I will reimburse you for expenses incurred, plus any reasonable necessary, additional fees, for attending to this, as well as any other reasonably necessary, related expenses within 14 days of the occurance. I also authorize you to purchase any foods, medications or related items recommended by the veterinarian.
3. In the event that I leave without providing my pet(s) with required dietary needs or medications, I specifically authorize you to purchase any needed items, such as food, medications or any other related items. I agree to reimburse you for the cost of the purchased items, and any additional expenses for transportation and time required to purchase said items.
4. I will be responsible for all medical expenses and damages resulting from an injury to the pet sitter or other persons by the pet(s) or any condition of my premises. I agree to indemnify and hold harmless Companion Keepers in the event of a claim by any person injured by the pet(s) or premises.
5. I agree it is expressly understood that Companion Keepers shall not be held responsible for any damages to my property, or that of others, caused by my pets during its care.
6. In the event of inclement weather or natural disaster, your company is entrusted to use its best judgment in caring for my pet(s) and home. I also expressly agree to hold your company harmless for any consequences related to such decisions in the conduct of the services specifically set forth in this contract, including any negligent decisions. I specifically authorize your company to remove my pet(s) from my premises, if, in your company’s judgment you conclude that my pet(s) may be in danger. “Danger” includes, but is not limited to, inclement weather, natural disaster, fire, a condition of my premises, or another pet(s). I agree to pay for any fees or services incurred by your company or billed to me as a result of the removal of my pet(s) from my premises, under the conditions set forth in this paragraph, and the placement of my pet(s) in a kennel or at a veterinarian’s office, and I allow your company to choose a kennel or veterinarian, if the veterinarian or kennel of my choice is not available, or I cannot be reached.
7. I grant to Companion Keepers Cat Sitting, MBB Enterprises, LLC., and its representatives and employees the right to take photographs of my pet(s), and to copyright, use and publish the same in print and/or electronically. I agree that Companion Keepers Cat Sitting, MBB Enterprises, LLC may use such photographs of my pet(s) with or without my
name and for any lawful purpose, including, for example, such purposes as publicity, illustration, advertising, and web content.
8. I warrant that my pet(s) are currently vaccinated in accordance with local, state and federal laws and regulations
9. I understand that Companion Keepers will follow the directions of the Veterinary Release Form in case a pet should become injured or sick
10. I understand the Company reserves the right to terminate this contract at any time if their pet sitter, in his/her sole discretion, determines that the Client’s pet(s) poses a danger to the health or safety of itself, other pets, other people or their Pet Sitter. If concerns prohibit the Pet Sitter from caring for the pet, the Company will attempt to contact the Client to arrange alternative care. If the Client cannot be contacted, I authorize the Company to place my pet in a licensed kennel with all charges and fees arising to be the responsibility of myself.

PREMISES SPECIFICATIONS

1. neighborhood security service or gated security access while you will be caring for my pet(s). If I do have a neighborhood security service or gated security access that will be in operation, I have informed you of who they are, and they have been informed that your company will be coming to my home to care for my pet(s) in my absence. I agree that I will provide you with the details of information that I provided to the security service regarding your company and our agreement to care for my pet(s), along with the name of the person to whom I provided this information. I also agree that I will provide you with the required information to interact with the security system on my premises. If I have failed to do so, I agree to hold your company harmless for any decisions that your company chooses to make in making my premises available for care of my pet(s), and I agree to pay any fees, expenses or penalties that arise from such decisions by your company.
2. I agree I will be either charged for prolonged gate and security station entrance time or visit time may be reduced to cover excess waiting to access my neighborhood or street.

LEGAL SPECIFICATIONS

1. The parties agree to and covenant that it is their intention that this contract, its performance, and all suits or special proceedings arising from this contract or its performance shall be construed in accordance with, under, and pursuant to the laws of the State of Texas, and specifically agree that any action, special proceedings, or any other proceedings
that may be brought, which arises out of, in connection with, or by reason of this contract, shall be construed in accordance with any governed by the laws of the State of Texas.
Further, the clients agree that the laws of the State of Texas shall be applicable to and govern the exclusion of the law of any other forum, without regard to the jurisdiction in which any action or special proceeding may be instituted because of, in connection with or under this contract or its performance.
2. The parties agree that this contract contains all the provisions and understandings of the parties with respect to the subject matter contained herein. This contract may not be changed except in writing duly signed by the parties herein, with the one exception of the oral modification of dates or fees for future services as set forth in this contract. There are no conditions to this contract that are not expressly set forth herein.
3. The Parties agree that this contract, including any subsequent verbal requests for services, as set forth shall be a part of this contract with modifications on fees, as described may be terminated by me for any reason by written notice when possible prior to the first date of performance of services, or verbal notice at least one day prior to the first date of performance of services under this agreement or after the last date of performance of services under this agreement.
4. This contract may only be terminated or breached by Companion Keepers, without the requisite notice set forth in this paragraph, during a service period, in the case of an emergency.
An “emergency” shall include, but not be limited to: (1) the client’s home becoming unsafe or uninhabitable during the service period and/or the client’s absence; (2) the client’s home becoming inaccessible; (3) the client’s pet becoming a danger or threat to the health, safety and/or well-being of Companion Keepers; (4) an act of God and/or natural or
man-made disaster; and/or (5) circumstances beyond the control of Companion Keepers that would make performance of this contract impossible.
5. The Company reserves the right to refuse service to any client, at any time, for any reason.
